These terms cover your use of papabrasa.com, operated by El Tucan Group, LLC(doing business as “Papa Brasa”). When you use the site, you agree to these terms. If you don’t, don’t use the site.
Who we are
El Tucan Group, LLC is a Maryland limited liability company operating Papa Brasa, a Peruvian rotisserie chicken restaurant brand. “Papa Brasa,” the Papa Brasa logo, and related marks are trademarks of El Tucan Group, LLC (US trademark application pending under USPTO Class 043, Restaurant services).
Use of the site
You can browse the site, sign up for our launch list, and (eventually) place orders. In return, you agree to:
- Provide accurate information when you give us your email or place an order.
- Not scrape, mirror, or systematically copy the site. Reasonable manual browsing is fine.
- Not attempt to break, probe, or interfere with the site’s security, performance, or availability.
- Not impersonate another person or use the site for illegal purposes.
Intellectual property
All content on the site — branding, logo, photography, menu descriptions, recipes (as expressed in writing), copy, and the underlying code — is owned by El Tucan Group, LLC or its licensors, and is protected by US copyright and trademark law. You can share links to the site freely. Reproducing content beyond fair use requires our written permission.
You are not permitted to use the Papa Brasa name, logo, or other trademarks for any purpose without prior written consent.
Email signups and communications
If you give us your email through the site, you’re consenting to receive a small number of pre-launch and opening-related messages. Every email includes a one-click unsubscribe. Unsubscribing removes you from our list. See the Privacy Policy for full data-handling details.
Ordering and payments (when applicable)
Online ordering is not yet available. When it goes live:
- Orders are subject to availability. We may cancel and refund an order at our discretion (kitchen capacity, ingredient shortages, suspected fraud).
- Prices are listed in US dollars. Sales tax is added at checkout where applicable.
- Payment processing is handled by a PCI-compliant third-party payment processor. We do not store your card information on our servers.
- Delivery, when offered through third-party delivery marketplaces, is governed by those platforms’ own terms in addition to ours. Their terms appear on their own apps and websites at the time you place an order.
- Refunds: contact us within 24 hours of an order if there’s a problem and we’ll make it right.
Food allergens and safety
Our menu items may contain or come into contact with common allergens including but not limited to dairy, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame. We prepare food in a shared kitchen — we cannot guarantee any item is allergen-free. If you have a serious allergy, talk to staff before ordering. Order at your own risk.
Disclaimer
The site is provided “as is.” While we work to keep it accurate and online, we don’t guarantee that everything on the site is error-free or that the site will be uninterrupted. Menu items, prices, hours, and other details may change.
Limitation of liability
To the fullest extent permitted by law, El Tucan Group, LLC, its members, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or our services. Our total liability for any claim arising from these terms or the site is limited to the amount you paid us in the six months before the claim arose, or $100, whichever is greater.
None of this limits any rights you have under applicable law that cannot be waived.
Governing law
These terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-laws principles. Any dispute must be brought in the state or federal courts located in Maryland.
Changes to these terms
We’ll update these terms as the site evolves. The “last updated” date at the top tells you when they changed. Continued use of the site after a change means you accept the updated terms. For material changes that affect your rights, we’ll email everyone on the list before the change takes effect.
